By subscribing to any BomPixel plan, you agree to the following terms and conditions that govern the provision of our services.
Services offered
BomPixel offers design, development, hosting and maintenance of websites for local businesses under a monthly or annual subscription model. The scope of each plan is detailed on our pricing page.
Subscription and payments
The client agrees to make subscription payments on time. Payments are monthly or annual depending on the chosen plan. When paying the full annual subscription, the setup cost is waived.
Late payments
If the client has a payment delay of more than 15 days, the website will be temporarily deactivated until payment is regularized. Content will not be deleted during this period.
Content ownership
Content provided by the client (text, logos, own photos) remains the client's property. AI-generated photos by BomPixel are for exclusive use on the client's website.
Hosting and domain
Hosting is included in all plans. The site is hosted as a BomPixel subdomain or on the client's own domain. The cost of a custom domain is covered by the client.
Cancellation
The client may cancel their subscription at any time without penalty. Upon cancellation, the website will be deactivated at the end of the paid period. No refunds are issued for partial periods.
Service modifications
BomPixel reserves the right to modify these terms with 30 days prior notice to the client. Continued use of the service after changes constitutes acceptance of the new terms.
Limitation of liability
BomPixel is not responsible for loss of revenue or data resulting from temporary service interruptions. We commit to maintaining 99.9% hosting uptime.
Acceptable use
The client agrees not to use the website to publish illegal, defamatory, discriminatory, pornographic content or content that infringes third-party rights. BomPixel reserves the right to deactivate the website without prior notice if content violating these conditions is detected. The client is responsible for any third-party claims arising from content published on their site.
Applicable law and jurisdiction
These terms are governed by the laws of the Republic of Costa Rica. Any dispute will be resolved before the competent courts of San Jose, Costa Rica. This commercial relationship is additionally governed by the Consumer Protection Law (Law 7472) and the Data Protection Law (Law 8968).
